Halle Berry puts restraining order on ex Gabriel Aubry

Whatever happened to ‘Tis the season’? Halle Berry is allegedly taking ex Gabriel Aubry back to court after an incident occurred on Thanksgiving.  Berry’s fiance and herself got into a blowout brawl with Aubry.

According to TMZ, the actress is seeking a restraining order against Aubry after starting a fight with Martinez in front of their 4 year old daughter. Berry believes he is a threat to their daughter. A judge issued an emergency order of protection for Berry, Martinez, and her daughter Nahla, but the order expires on Tuesday.

Sources tell TMZ that’s Berry’s lawyers are working to make the protection more permanent. The actress bases this decision on the argument that “If Gabriel can’t control himself enough to protect Nahla from emotional trauma, it’s too risky for him to be around her, Berry, or Martinez.”

This has not been the first incident Berry has had with Aubry. The two have been to court on numerous occasions within the last two years addressing his uncontrollable temper. Both Aubry and Martinez ended up in the hospital following the fight that left Aubry with head contusions and a broken rib. Martinez suffered neck injuries and a bruised hand. Aubry was arrested after visiting the hospital and is facing battery and misdemeanor charges.
